Artpodaraci.com is an internet site, that represents a trade center for online trade, and is a posession of the company "Lilia" . All the prices in the site are final and do not include the price of the supply. All the prices are valid till the  exhaustion of the quantities. "Lilia" preserves its right to change the prices of the products, without notifying its clients, and also to correct parameters of the products. Misprints, differences in the colour visualisation of the user computer configuration and  changes of the design of the products are possible. The consistency of this site cannot be copied or shown without the written agreement of "Lilia".

Definitions

„Lilia” owns the internet site http://www.artpodaraci.com , representing an online shop for handmade art gifts  (“The Site”);

“User” is everyone, who loads in Internet on its computer  the web page http://www.artpodaraci.com;

“Product/ Products” are the offered for buying products through the site;

"Order" is an individual order from the User  for buying of the chosen Product/Products according to the conditions of supply and way of payment.

"Services" are all the actions, realised by „Lilia” during the offering, the selling or the supply of the Prudct / Products.

Introduction

This document consists the Terms of use, according which "Lilia" offers services to its users through the internet site. Each user is bound to these terms of use fot the whole time of use of the internet site. The identification of the user with the aim to reproduce its declaration for accepting the terms of use is realised by keeping in the log-files on the server  www.artpodaraci.com of the IP address of the user and of every other conceded information.

By loading of whatever page of the site www.artpodaraci.com, The User, no matter if registered as a client or not, declares, that he accepts the Terms of Use and he is obliged to respect them. The Terms of Use are issued on a visible part of the site and are accessible for each User.

Aims of the Terms of Use

The Terms of Use define the relations, connected with the offering of services from "Lilia" through the site.

Products

The products, object of sale, are the products offered in the site at the moment of sending the order form the part of the User. They are described by type and quality and are classified in different categories by commun characteristics. "Lilia" does not bear any responsibility for possibe differences in the colour of the sold products, due to specifications in the screens of the computers. The order for buying a Product / Products is accepted as an expressed concent from the Part of the user concerning the Products type and quality.

Claims

A client, ordered a product, can refuse the Product after the supply only in thesecases: When there is an obvious lack or correspondance between the ordered and supplied Products, when during the transportation the Product has been dammaged. The reclamation in these cases can be realised only at the moment of the supply of the Product.

Claims are accepted as follows: 1. In a legal delay of 24 hours after the supply of the Products, if there is a defect ot lack of correspondance, determined during the examination of the Product. 2. If there is lack of correspondance between an ordered and supplied Product, that couldnt be determined at the moment of receiving the Product, the Product can be changed in a delay of 3 working days after the clients order.

Rights and Obligations of the User

The User has the right to examine, order and receive Gifts from the Site according the therms and conditions , pubished in the site.

The User has the right to inform himself about the status of his order.

The User has the right of supply of the ordered Product/Products at the indicated address of supply, after the payment of the price according the Terms of Use, published in the site.

The User bears the ful reponsibility for keeping safe his user name and password, and also for all the actions, realised by him or other person by using his user name and password, The user is obliged to immediately inform "Lilia" and the correspondant authorities for each case of unauthorised access by using his user name and password, and for each case, when there is a danger for such an use.

The user is obliged to pay the price of the Order according to the published in the site way of payment.

 Each User, no matter if he has made and order or not, is obliged, when using the Services:

§ to not violate and respect the rights of people, according to the Constitution, the laws of Republic of Bulgaria and the international acts, at which Bulgaria is a part, the rules of ethics, the Internet ethics when using the offered by "Lilia" services;

§ to not violate other's material or immaterial, absolute or relative rights and interests, as right of possession, intellectual rights and others;

§ to inform immediately "Lilia" and the respective authorities about each case of completed or discovered violation during the use of the granted Services;

§ not to load, send, deliver, diffuse or use, in whatever way and not to make known to third persons a software, computer programs, files, applications or other materials, containing computer viruses, systems for unauthorised remote control, computer codes or materials, meant to disconnect, make difficult, violate or restrict the normal functioning of the computer hardware or software and the telecommunication devices or meant to unauthorised infiltration or access to foreign resources or software;

§ not to make harmful actions.

The Users of the site do not have the right to diffuse, change, copy (except for not trade, personal aims), deliver, expose, reproduce, publish, create secondary materials, transfer, sell or in whatever way use content of the site without the explicit permission of "Lilia".

Rights and obligations of "Lilia"

"Lilia" has not the obligation and the objective possibility and does not control the way, in which the User uses the Services on the site.

"Lilia" has the right, but not the obligation, to preserve materials and information, used/disposed on the servers of Artpodaraci.com or made known to third person by the User, and to concede them to third persons and the respective State authorities in the cases, when this is necessar for the protection of the rights and law interests, the possession and the security of "Lilia", and also of third persons, in cases of presented claims in connection of violation of their rights in connection with used or diffused information or materials, and also in cases, when the materials or the information are required for the State authorities, on the strength of a precise law decree.

"Lilia" has the right at each time, without informing the User, when the last uses the Services in violation of the present Terms of Use, and also according to the estimation of "Lilia", to stop or change the granted Services, "Lilia" has not the responsibility towards the Users and third persons for endured damages or missed benefits, occured in consequence of the termination, the change or the restriction of the Services, the erasure, the modification , the loss, the untrustworthiness, the inexactitude or the incompleteness of massages, materials or information, transferred, used, recorded or become accessible through "Lilia".

"Lilia" can publish in the rubrics of the shop hyper-links leading to other Internet sites and resources. "Lilia" does not carry any responsibility for any damages or missed benefits, resulting from the use, the access or the trustworthiness of those materials and content. The User carry the full responsibility for all the caused damages to Artpodaraci.com and third persons resulting from the use or access to those Internet pages and resources.

"Lilia" does not carry any responsibility for damages, caused to the software, hardware ot the telecommunication devices or for any loss of data, resulting from materias or resources searched, loaded or used in whatever way through the granted Services. The advices, the consultations or the assistance, rendered by employees of "Lilia:" regarding the use of the Services by the Users, do not result in any responsibility or obligations for "Lilia". The user is obliged to compensate "Lilia" and all third persons for all the damages and missed benefits, including all expenses and paid lawyer remuneration, resulting from presented claims and/or paid compensations to third persons in connection with Internet sites, hyper-links, materials and information, that the User used, disposed on the server, sent, diffused, made known to third persons or made accessible to "Lilia" in violation of the law, the present Terms of Use, the good morals and the Internet etiquette.

"Lilia" has the right to gather and use information concerning its Users, in order to ameliorate its services. All the purposes, for which "Lilia" will use the information will be conformable to the Bulgarian laws, the appliable international statements, the good morals and the Internet etiquette. Change in the Terms of Use

The general Terms of use can be changed by "Lilia" at every time, "Lilia" has the obligation to inform the User for any changes in the Terms of Use, by publishing a nottice about the changes and also the changes in the Site. The User is considered bounded with the changes in the Terms of Use from the moment of their publishing, except if he declares not accepting the changes. In case when the User declares, that he doens not agree with the changes, than Artpodaraci.com has the right to stop the granting of Services to the User. The occured obligations up to this moment are subjected to execution.
